Your use of the Plainfield Public Library Foundation (the “Foundation”) web site (the “Site”) is subject to your compliance with the terms and conditions (the “Terms”) set forth below. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE VISITING OTHER PAGES ON THE SITE. BY VISITING OTHER PAGES ON THE SITE, YOU AGREE TO BE BOUND BY THE TERMS SET FORTH BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS , YOU SHOULD NOT VISIT OTHER PAGES ON THE SITE. The Foundation MAY MODIFY THESE TERMS AT ANY TIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE MODIFIED TERMS ON THE SITE. 1. Intellectual Property.
The entire contents of the Site are protected by international copyright and trademark laws. The trademarks and copyrights are property of the Foundation or its affiliates unless otherwise noted. YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE. You may print and download portions of material from the Site solely for your own non-commercial use provided that you do not modify or delete any proprietary notices from the materials or modify the materials themselves. Your use of such materials does not transfer any ownership rights in the materials to you. You hereby grant to the Foundation a non-exclusive, royalty-free, worldwide, sublicensable, perpetual license to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform, by all means and in any media now known or hereafter developed, any materials and other information (including, without limitation, ideas contained therein for new or improved products and services, collectively, “Submitted Materials”) you submit through the Site or by e-mail, with the exception of the personal information governed by our Privacy Policy [provide link]. You also grant to the Foundation the right to use your name in connection with the Submitted Materials as well as in connection with all advertising, marketing and promotional materials related thereto. 3. Limitation of Liability

You agree to indemnify, defend and hold harmless the Foundation, its officers, directors, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from your violation of any of the Terms stated hererin (including negligent or wrongful conduct) or any applicable laws.

5. Online Donations.
The Plainfield Public Library Foundation is a 501(c)3 charity. Your gift is tax-deductible as allowed by U.S. Law. As noted above, inaccuracies may from time to time occur in relation to the Current Needs listed on the Site. We apologize for any inconvenience this may cause. 6. Miscellaneous.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois applicable to agreements made and to be performed in the State of Illinois. In the event that you wish to assert any claim against the Foundation for any purpose whatsoever, you expressly agree that such dispute will be determined exclusively by arbitration pursuant to the rules of the American Arbitration Association. Any claim you may have must be commenced in arbitration within one (1) year after the claim or cause of action arises or such claim or cause of action is forever barred. The Foundation’s failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. If any given provision of these Terms is found to be invalid, the other provisions of these Terms shall remain in full force and effect. The Foundation may assign its rights and duties under these Terms to any party at any time without notice to you. Any rights not expressly granted herein are reserved.
